Terms of Service

These Terms of Service ("Terms") govern your access to and use of Bastion (the "Platform"), operated by Bastion. By creating an account, you agree to these Terms. If you do not agree, do not use the Platform.

1. What Bastion Is

Bastion is a marketplace and escrow-facilitation platform for the peer-to-peer sale of luxury goods, including but not limited to watches, vehicles, footwear, jewelry, handbags, art, instruments, and collectibles. Bastion connects buyers and sellers and provides tools intended to reduce the risk of fraud in private-party transactions. Transactions may be completed by in-person exchange or by shipment, and where an item is shipped, Bastion provides the shipping label, tracking, and delivery record for that transaction.

2. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use Bastion. By creating an account, you represent that you meet these requirements.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
• Your public handle is shown to other users; your real name and email are never shown publicly.
• You agree to provide accurate information when creating listings, including item condition, authenticity, and any material defects.

4. Listings and Transactions

• Sellers are solely responsible for the accuracy of their listings and for the authenticity and legal ownership of any item listed.
• Buyers are responsible for reviewing listing details and asking questions before beginning a purchase.
• Funds for a transaction are held in escrow and are not released to the seller until the buyer confirms receipt of the item as described, or until a shared release code is used to confirm an in-person exchange.
• Bastion charges a protection fee on each completed transaction, disclosed at checkout before purchase.

5. Shipping

• Where a transaction is fulfilled by shipment, the shipping label is generated by Bastion through its carrier partner. Sellers may not substitute their own label or supply their own tracking number for a Bastion transaction.
• Shipping costs are quoted to the buyer at the carrier's live rate prior to purchase and are paid by the buyer.
• The delivery address is fixed at the time of purchase and cannot be altered afterwards. A change of destination requires cancellation of the transaction.
• Bastion does not ship to PO boxes, general delivery addresses, or freight-forwarding addresses. Shipping is available within the United States.
• All shipments require a signature on delivery. Transactions above value thresholds published on the Shipping page additionally require adult signature, double-boxing, and a continuous unedited packing recording by the seller.
• Sellers must tender the package to the carrier within the ship-by deadline shown on the transaction. Failure to do so entitles the buyer to cancel the transaction for a full refund.
• Bastion records the carrier's declared value for each shipment. A declared value is not a policy of insurance. Bastion does not sell, provide, or procure shipping insurance, and makes no representation that any shipment is insured.
• Delivery confirmation by the carrier does not itself release funds. Delivery begins the buyer's inspection window, during which the buyer must confirm receipt or report an issue.
• Packing and unboxing evidence submitted by either party is retained against the transaction and cannot be withdrawn or amended once submitted.

6. Disputes

If a transaction is disputed by either party, funds remain held in escrow and the transaction is paused pending review. Bastion will make reasonable efforts to review disputes fairly but does not guarantee a particular outcome. Bastion's decision on a disputed transaction is final.

7. Prohibited Conduct

• Listing stolen, counterfeit, or misrepresented items.
• Attempting to complete a transaction outside of Bastion's escrow system to avoid fees or protections.
• Harassing, defrauding, or attempting to defraud another user.
• Creating multiple accounts to evade a suspension or ban.

Violation of these Terms may result in suspension or permanent removal of your account, at Bastion's discretion.

8. Prohibited Items

The following may not be listed on Bastion. This list is not exhaustive, and Bastion may remove any listing at its discretion.

• Live animals of any kind, including pets, livestock, exotic and wild animals, and any animal-derived product whose sale is restricted by law (including ivory, and products from protected or endangered species).
• Firearms, ammunition, explosives, and regulated weapons, including component parts requiring a licensed transfer.
• Controlled substances, prescription medication, and drug paraphernalia.
• Human remains or bodily material.
• Hazardous materials that common carriers refuse to transport, including compressed gases, corrosives, and flammable liquids.
• Stolen property, or any item the seller cannot lawfully transfer.
• Counterfeit goods and unauthorized replicas.
• Government identification documents, financial instruments, and account credentials.
• Digital-only goods with no physical item to ship or hand over, since these cannot be verified through Bastion's inspection process.
• Any item whose sale or transfer requires a licence the seller does not hold.

Bastion is built around escrow, physical delivery and a buyer inspection window. Categories that cannot be meaningfully inspected, lawfully transported by a common carrier, or returned without harm fall outside what this platform can protect, and are prohibited for that reason.

9. No Guarantee of Authenticity

While Bastion provides tools to reduce fraud risk, Bastion does not independently authenticate items listed by sellers unless explicitly stated otherwise for a given transaction. Buyers are encouraged to conduct their own due diligence.

10. Limitation of Liability

Bastion is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, to the fullest extent permitted by law. Bastion's total liability for any claim is limited to the fees you paid to Bastion for the transaction giving rise to the claim.

11. Changes to These Terms

Bastion may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
