Terms of Service
These Terms of Service ("Terms") govern your access to and use of Bastion (the "Platform"), operated by Bastion. By creating an account, you agree to these Terms. If you do not agree, do not use the Platform.
1. What Bastion Is
Bastion is a marketplace and escrow-facilitation platform for the peer-to-peer sale of luxury goods, including but not limited to watches, vehicles, footwear, jewelry, and collectibles. Bastion connects buyers and sellers and provides tools intended to reduce the risk of fraud in private-party transactions.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use Bastion. By creating an account, you represent that you meet these requirements.
3. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
- Your public handle is shown to other users; your real name and email are never shown publicly.
- You agree to provide accurate information when creating listings, including item condition, authenticity, and any material defects.
4. Listings and Transactions
- Sellers are solely responsible for the accuracy of their listings and for the authenticity and legal ownership of any item listed.
- Buyers are responsible for reviewing listing details and asking questions before beginning a purchase.
- Funds for a transaction are held in escrow and are not released to the seller until the buyer confirms receipt of the item as described, or until a shared release code is used to confirm an in-person exchange.
- Bastion charges a protection fee on each completed transaction, disclosed at checkout before purchase.
5. Disputes
If a transaction is disputed by either party, funds remain held in escrow and the transaction is paused pending review. Bastion will make reasonable efforts to review disputes fairly but does not guarantee a particular outcome. Bastion's decision on a disputed transaction is final.
6. Prohibited Conduct
- Listing stolen, counterfeit, or misrepresented items.
- Attempting to complete a transaction outside of Bastion's escrow system to avoid fees or protections.
- Harassing, defrauding, or attempting to defraud another user.
- Creating multiple accounts to evade a suspension or ban.
Violation of these Terms may result in suspension or permanent removal of your account, at Bastion's discretion.
7. No Guarantee of Authenticity
While Bastion provides tools to reduce fraud risk, Bastion does not independently authenticate items listed by sellers unless explicitly stated otherwise for a given transaction. Buyers are encouraged to conduct their own due diligence.
8. Limitation of Liability
Bastion is not liable for indirect, incidental, or consequential damages arising from your use of the Platform, to the fullest extent permitted by law. Bastion's total liability for any claim is limited to the fees you paid to Bastion for the transaction giving rise to the claim.
9. Changes to These Terms
Bastion may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
